These Terms of Service (the “Terms”) govern the use of the website operated by EVIL PICKLEBALL INC., including evilpickleball.ca, as well as the purchase of products and use of the services offered through it.
In these Terms, the terms “EVIL Pickleball,” “we,” “us,” and “our” refer to EVIL PICKLEBALL INC.
By using our website or making a purchase from us, you agree to these Terms and the policies referenced herein, including our Privacy Policy, Return and Refund Policy, and Shipping Policy.
Nothing in these Terms limits any rights granted to consumers under applicable laws, including Quebec’s Consumer Protection Act.

You may use our website only for lawful purposes and in accordance with these Terms.
You agree, in particular, not to:
- use the website for fraudulent or unlawful purposes;
- attempt to gain unauthorized access to our systems or accounts;

- collect or use personal information concerning other users without authorization;
- reproduce, copy, or exploit website content in violation of applicable intellectual property rights.
We may restrict or suspend access to the website where there are reasonable grounds to believe that a person is using it fraudulently, abusively, in violation of these Terms, or contrary to applicable laws.

Where a specific characteristic is essential to your purchase, we recommend that you contact us before placing your order.
4. Pilla Products and Configurations
Certain Pilla products may be sold as configurable kits that allow customers to select, among other things:
- the number of lenses;
- lens tints;
- frame model;
- frame colour;
- certain options or upgrades;
- certain personalized or prescription components.
It is the customer’s responsibility to review the selections made before confirming the order.
The information and recommendations provided on our website regarding lenses are intended to assist customers in selecting products suitable for their intended conditions of use. They do not constitute medical or professional advice concerning vision or eye health.
Personalized products, products prepared according to specific requirements, or prescription products may be subject to special return conditions in accordance with our Return and Refund Policy.
5. Prices
Unless otherwise stated, prices displayed on our website are in Canadian dollars (CAD).
Applicable taxes and shipping charges are calculated according to the shipping address and are displayed before the transaction is completed where required.
We may change our prices, promotions, and offers for future transactions.
A price change made after an order has been completed does not affect the price agreed upon for that order unless the customer expressly agrees to a modification permitted by law.
Discounts and promotional codes are subject to the conditions indicated when issued and generally cannot be combined unless otherwise stated.
6. Pricing or Information Errors
Despite our efforts, an error may occasionally appear in a price, description, or other information published on our website.
Where an error is identified before an order has been fulfilled, we may contact the customer to explain the situation and present the available options in accordance with applicable laws.
We will not attempt to avoid a consumer’s statutory rights through a display error or through these Terms.
7. Orders
When placing an order, you must provide accurate and complete information.
Before confirming your order, you have the opportunity to review and correct the information relating to your purchase.
For distance contracts entered into in Quebec, merchants are required, among other things, to provide information before purchase concerning the product, its price, applicable charges, delivery, payment, and the conditions relating to cancellation, returns, exchanges, and refunds.
After placing your order, you will normally receive a confirmation by email.
This confirmation also provides a means of retaining the information relating to your transaction.
Quebec legislation provides that a copy of a distance contract must be sent to the consumer within 15 days after it is entered into and must be capable of being easily retained and printed.
8. Product Availability
Our products are offered subject to availability.
A product that has been ordered may occasionally become unavailable due to, among other things:
- an inventory error;
- a discrepancy between physical and electronic inventory;
- damage to the product;
- supplier stock shortages;
- a technical issue.
In such a situation, we will contact you and may offer, depending on the circumstances:
- a replacement product;
- the option to wait for restocking;
- modification of the order;
- or a refund for the unavailable product.
9. Payment
You agree to provide accurate and valid payment information.
Payments may be processed through Shopify Payments or other payment service providers offered at the time of the transaction.
You authorize the processing of the amount displayed when your order is confirmed, including applicable taxes and shipping charges.
We do not normally retain your complete payment card number ourselves.
10. Taxes
Taxes are calculated in accordance with applicable tax rules and may vary based on factors including:
- the province or territory of delivery;
- the type of product;
- the tax registrations applicable to EVIL PICKLEBALL INC.
The amount of applicable taxes is displayed at the time of the transaction.
11. Shipping and Delivery
Orders are shipped in accordance with the terms set out in our Shipping Policy.
Delivery times displayed are generally estimates unless a specific commitment is expressly stated.
Certain circumstances beyond our control may result in delays, including weather conditions, carrier delays, transportation network disruptions, or periods of high shipping volume.
Any specific rights applicable to distance purchases remain fully applicable.
12. Returns, Exchanges, and Refunds
The conditions applicable to returns, exchanges, and refunds are described in our Return and Refund Policy.
Our voluntary commercial return policy does not limit any rights consumers may have under applicable laws, including rights relating to legal warranties, defective goods, and distance contracts.
13. Legal Warranties and Manufacturer Warranties
Products sold to consumers may benefit from legal warranties provided under applicable laws.
A manufacturer’s warranty may also apply to certain products.
Where a manufacturer’s warranty applies, we may assist you in identifying the appropriate procedure. A commercial or manufacturer’s warranty does not replace any applicable legal warranties.
14. Gift Cards
Where offered, gift cards are subject to the terms displayed at the time of purchase or use, as well as applicable laws.
They may only be used in accordance with the conditions authorized by EVIL PICKLEBALL INC.
15. Promotional Codes and Affiliate Programs
EVIL Pickleball may offer promotional codes, ambassador programs, or affiliate programs.
These codes:
- may be limited to certain products;
- may have an expiration date;
- may be limited to one use per order or per customer;
- may not be combinable with other promotions;
- may be modified or withdrawn for future transactions.
Any fraudulent, automated, or abusive use of a promotional code may result in its cancellation.

Unless otherwise stated, content created by EVIL PICKLEBALL INC. and appearing on the website, including:
- text;
- graphics;
- photographs;
- videos;
- graphic elements;
- layouts;
- EVIL Pickleball logos;
- custom code or content;
is protected by applicable intellectual property laws.
Certain names, trademarks, logos, images, and product-related content may belong to their respective owners or manufacturers, including brands that we distribute or resell.
Nothing in these Terms grants you any ownership rights in such materials.
You may view website content for your personal, non-commercial use. Any unauthorized reproduction, distribution, or commercial use is prohibited.

If you voluntarily submit a review, comment, photograph, or other content intended for publication, you represent that you have the right to provide it to us.

Our store is operated using the Shopify platform.
Certain e-commerce functionality, infrastructure, and services are therefore provided by Shopify or its service providers.
Use of our store may also be subject to certain technical mechanisms or conditions specific to Shopify.

We make reasonable efforts to keep our website accessible and operational.
However, we cannot guarantee uninterrupted or continuous access.

In particular, these Terms do not limit mandatory rights and remedies granted to consumers under applicable laws.

We are not responsible for delays or failure to perform resulting from an event reasonably beyond our control, subject to any rights and remedies provided under applicable laws.

- major transportation disruptions;
- major network failures;
